ASSAULT AND BATTERY OF A HIGH AND AGGRAVATED NATURE (ABHAN)

ABHAN is the most serious assault and battery charge in South Carolina. These charges involve the unlawful injury to another person and either great bodily injury results or the act is committed in such a way that is likely to result in great bodily injury or death.

This charge is a felony, and a conviction could get you up to 20 years in prison.

ASSAULT & BATTERY 1ST DEGREE

Assault & Battery 1st Degree is committed when one person unlawfully:

  • Injures another person and the act:
    • Involves nonconsensual touching of the private parts, or
    • Occurred during a theft, robbery, burglary or kidnapping.
  • Offers or attempts to injure another person with the present ability to do so and:
    • Is likely to produce great bodily injury or death, or
    • Occurred during a theft, robbery, burglary or kidnapping.

A conviction for this charge could get you up to 10 years in prison.

ASSAULT & BATTERY 2ND DEGREE

Assault & Battery 2nd Degree is committed when a person unlawfully injures another person, or offers or attempts to injure another person with the present ability to do so, and:

  • Moderate bodily injury results or could have resulted, or
  • Involves non-consensual touching of the private parts of another person.

A 2nd degree assault and battery charge is a misdemeanor and can get you up to three years in prison and/or up to a $2,500 fine.

ASSAULT & BATTERY – 3RD DEGREE

Assault & battery 3rd degree is when one person unlawfully injures another person, or offers or attempts to injure another person with the present ability to do so.

This charge is a misdemeanor, and a conviction can bring a sentence of up to 30 days in jail and/or up to a $500 fine.
